One seller was fined $800,000

In cross-border circles, tariff compliance has always been a topic of concern.

Recently, a foreign trade company on the back of 798,334 US dollars (about 5.7 million yuan) of a huge fine, because of unpaid tariffs, suddenly caused a hot debate in the industry. Specifically, the company allegedly misrepresented the value of the goods and failed to pay duties on furniture imported from China as required, in violation of the False Claims Act, also known as the False Claims Act.

The United States Customs law stipulates that goods imported into the United States must pay import duties and other taxes, and import taxes are all calculated on the value of the goods, that is, the FOB. The company submitted fake invoices to U.S. Customs and Border Protection between September 2018 and December 2022 in order to avoid paying reasonable duties, which resulted in lower value of goods imported into the United States, thus affecting U.S. tariff revenue.

In fact, this is not the first such case.

Previously, an eight-year-old seller in Guangdong was found by the relevant departments to hide income and unpaid taxes, evidence that the seller operated a number of shops there are tax evasion illegal acts, and finally made a fine execution. Coincidentally, in Jilin, cross-border companies were also found suspected of defrauding export tax rebates, the company used false value-added tax invoices, false foreign exchange settlement and other means to achieve the purpose, and finally was pursued to pay export tax rebates of 5.4879 million yuan, and the main offender of the illegal act was even sentenced to 10 years in prison by the court, the penalty of 5.5 million yuan…

Various cases show that although there are always some criminals in the cross-border e-commerce industry who have a lucky mind, they still cannot escape the sanctions of the law in the end, which is the so-called “the net of law has a long way to go.” These events also remind the majority of sellers that in the cross-border e-commerce industry, the importance of compliance is self-evident.
